Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to confined spaces: a) REACTOR FLOOR: EMPLOYEES WERE REQUIRED TO ENTER A CONFINED SPACE (REACTOR VESSELS) TO PERFORM CLEANING OPERATIONS AFTER COMPLETION OF CHEMICAL REACTIONS TO PRODUCE ACRYLIC POLYMERS. THE TANK ETNRY PERMIT HAD PROVISION REQUIRING: (1) FLASH TEST TAKEN FOR FLAMMABLE VAPORS, AND (2) TESTS TAKEN FOR OXYGEN DEFICIENCY. HOWEVER, NO ATMOSPHERIC TESTING WAS CONDUCTED PRIOR TO VESSEL ENTRY.
