Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a)  At the hydrostatic test apparatus employees are exposed
to the hazard of compressed gas cylinder failure.  The
following conditions contribute to the existence of this hazard:
1.  The use of a compressed gas cylinder as a hydrostatic
pressure accumulator at pressures in excess of the rated
capacity of the cylinder had not been approved by a
competent person such as a professional engineer.
2.  The cylinder had not been placed within a protective
barrier or otherwise isolated in a manner that would not
subject employees to injury in the event of cylinder failure.
Feasible methods of abatement would include the following:
1.  Approval by a competent person that routine over-pressurization
of the cylinder would not cause the cylinder to fail in such a
way that creates a hazard to employees.
2.  Place the cylinder within a protective enclosure that would
prevent employee injury in the event of cylinder failure.
