Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
an oxygen deficient atmosphere while performing work inside of tanks:
a) Project conducted on site at Anderson Junk Yard; procedures were
inadequate for entering and performing chipping operations on frozen
primer material in holding tanks of approximately 100 and 1500 gallon
capacity. (on or about March 5-7, 1990.)
Abatement Note: Among other methods, one feasible and acceptable
abatement method to correct this hazard is to establish a confined
space entry program which would include at least the following
essentials:
1) Prepare and make available confined space entry (CSE) procedures.
2) Train employees and supervisors in safe CSE procedures.
3) Include a management sign-off (authorization) and hazard control
checklist for all CSE procedures.
4) Include provisions for the testing of oxygen and combustible
gas/vapor levels.
5) Provide for medical assistance for all personnel performing CSE
work.
6) Post warning labels and signs in the area of CSE work.
7) Assure adequate ventilation, safe electrical equipment and proper
work practices in all CSE work.
8) Ensure a standby worker and his proper functions during CSE work.
9) Provide proper rescue equipment, including, but not limited to,
lifelines and harnesses.
10) Provide a self contained breathing apparatus for CSE emergencies.
11) Ensure CSE work is being performed with proper safety equipment,
including, but not limited to eye and respiratory protection.
