Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer shall furnish did not furnish employment and a place of employment which were free from recognized hazards that where causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck and buried by raw sugar which was loaded into railcars by the use of a "slinger" that deposited approximately 300 pounds of sugar per/second. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have the "slinger" operator check each railcar prior to loading to ensure that no employee has entered the hazardous loading area as required by paragraph 6.18.2 (f) of the American Society of Mechanical Engineers B20.1a-1991 for conveyors and related equipment.
