Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)at the work site at 510 Market Street where the company did not use warning signs or similar devices to warn traffic of employees work activity on or near the road. On or about July 15, 1994 an employee was struck by a vehicle while performing work on ro near the curb line of Market Street. Among other methods, one feasible and acceptable method for abatement is to provide, require, and enforce the use of appropriate warning signs to warn traffic of work activity near or on the road (as required by the Texas Manual on Uniform Traffic Control Devices for street and Highways.)
