Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the recognized hazard of being struck by
falling portions of the hoisted load or the hoist itself of 3
Overhead Hook Chain Hoist located in the machine shop.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to properly load test the hoist
supporting structure ("I beam") and then have the determined load
rating marked on the supporting structure in accordance with
Paragraph 16-1.1.3.1 of the American National Standards Institute
(ANSI) B30.16-1973, Hand Chain Power Hoists.
