Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of oxygen deficiency and/or excessive carbon monoxide
concentration:
a) Frelinghysen School, W. Hanover Ave., Morris Township, NJ;
Employee entered a number 2 fuel oil tank which had a 15,000 gallon
capacity and was 4' deep x 10' long x 5' wide, without first
establishing and following minimally adequate confined space entry
procedures.
Among other methods, feasible and acceptable abatement methods to
correct this hazard would include the implementation of confined space
entry procedures as outlined in American National Standards Institute
Z117.1-1989.
Such procedures would include:
a) Atmospheric testing of the tank for percent oxygen and combustible/
flammable vapors and any toxic materials expected or possibly
introduced into the tank; eg. carbon monoxide generated from
internal combustion engine driven ventilators.
b) Having a full time stand-by man properly trained and equipped to
effect emergency rescue or summon help in the event of a medical or
other emergency.
c) use of a permit entry system which considers all potential hazards
as referenced in ANSI Z117.1-1989.
