Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by an overloaded vehicle overturning during unloading operation: a) Tri-County Asphalt Corp, Eisenhower Parkway, Roseland, NJ Employee(s) were exposed to an overloaded tractor and dump trailer whose gross vehicular weight (GVW) was 86,600 pounds (lbs), being emptied by raising the body. This weight was not in conformity with the manufacturers specification of a maximum GVW of 80,000 lbs, nor, with the New Jersey State Department of Transportation standard 39:3-84.3 maximum of 80,000 lbs. GVW. Among other methods, one feasible and acceptable abatement method to correct this hazard is to not allow loading, or acceptance, of tractor dump trailers in excess of 80,000 pounds gross vehicular weight. Violation occurred on or about 7/20/90
