Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, dental workers were exposed to the hazards of being infected with Hepatitis B or other blood borne diseases through possible direct contact with blood or other body fluids. A feasible and useful abatement method for reducing this hazard, among others is: Developing an effective follow-up program for health-care workers who experience a percutaneous cut, cutaneous exposure from nonintac t skin, or splash to a muccus membrane. A program would include followup procedures as outlined by CDC published guidelines and OSHA's CPL 2-2.44B.
