General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to an explosion hazard due to vapors from combustible and flammable liquids while excavating removing and cleaning underground petroleum storage tanks: (a) Drake Bakeries, 90 Forbes Boulevard, Mansfield: The liquid contents of a waste oil tank were not pumped out prior to lifting the tank out of the ground and cutting the tank in acordance with American Petroleum Institute recommended practice 1604 section 4.1.3 and Office of the State Fire Marshall 502 CMR 3.04(2). The vapors of a waste oil tank were not purged prior to lifting the tank in accordance with American Petroleum Institute recommended practice 1604 section 4.2 and Office of the State Fire Marshall 502 CMR 3.05. The atmospheres of a waste oil tank and a diesel fuel tank were not tested for flammable or combustible vapor concentrations prior to lifting the tank out of the ground and cutting the tank in accordance with American Petroleum Institute recommended practice 1604 section 4.3 and Office of the State Fire Marshall 502 CMR 3.05(4). It is recommended to remove the liquid with a vacuum truck. It is recommended to use a diffused air blower or to inert the tank. It is recommended to test the tank atmospheres with a combustible gas indicator.
