Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees, in that, employees were exposed
to recognized hazards of there being no means of rescue readily available
for employees working inside a confined area:
(a)  Tank #2, where an employee was required to enter into the tank
and take oxygen and LEL measurements throughout the tank prior to
others entering and hourly while Amex employees are inside applying
Styrene monomer, and no means of rescue were readily available.  This
subjects the employee to the hazard of not being rescued quickly if
overcome by toxic or oxygen deficient atmospheres.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to have self-contained breathing apparatuses
and employees on site and readily available who have been properly
trained on the use of SCBAs and on confined space rescue procedures.
