Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were cusing or likely to case death
or serious physical harm to employees, in that, employees were exposed
to entering a confined space without a written program recognizing

and explosive becoming overcome by toxic gases, oxygen deficeint and
explosive atomospheres while performing work duties from points located
within manholes, shafts and tunnels:
(a) Jobsite: Old Fall River Road, Dartmouth, MA, Manholes 2,3 and

telephones or other signal communications between standby personal

instructions of the hazards in confined space, atmospheric testing
and monitoring or oxygen deficiency; and other aspects of NIOSH
publications No. 80-106.
