Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to working conditions and recoginized hazards of being overcome by toxic gas and/or oxygen deficient atmospheres while entering into and working inside of tanks: (a) Rubber Department, Vacuum Tank 3, employees enter and work inside the tank without following proper confined space entry procedures. This subjects the employees to the hazards of being asphyxiated due to lack of oxygen or being overcome by toxic air contaminants. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish and enforce adequate confined space entry procedures, such as those stipulated by ANSI Z117.1-1989. These procedures include developing a program that includes a permit system, atmospheric testing, an assigned attendant who keeps constant direct communication during the time the employee is inside the confined space, a program of isolation and lockout, emergency response procedures including rescue equipment such as harnesses and lifelines, and training of employees required to enter the confined space and training of standby attendants.
