Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees, in that, employees were exposed
to entering a confined space without a written program recognizing hazards
of possibly becoming overcome by toxic gases, oxygen deficient and
explosive atmospheres while performing work duties from points located
within manholes, shafts and tunnels:
(a) Jobsite:  Catch basin, pumping and secondary manholes:  Reynold
Bros. employees entered manholes without following confined space
entry procedures.  Employees were exposed to the hazard of being
asphyxiated due to the possible lack of oxygen at their work
locations or potentially exposed to a toxic and/or explosive
atmosphere.  No atmospheric testing was conducted prior to enter-
ing manholes
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to establish and enforce a confined space entry
program, such as that stipulated by NIOSH criteria document and
publications No. 80-106, December 1979, which includes providing telephones
or other signal communications between standby personnel and the employees
in the confined space; training and providing instructions of the hazards
in confined space; atmospheric testing and monitoring for oxygen
deficiency, toxic gases and explosive atmospheres; and other aspects of
NIOSH publication No. 80-106.
