Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in that, employees were exposed to the
following conditions:
(a) (1) Second Floor Roof:  The double hung windows located on the
second floor roof adjacent to the platforms leading from stairwells
1 and 2 were not labeled fire window frames, as required by NFPA 80
Section 12-1.1, 1983.
(a) (2) Basement:  The basement window located beneath the base of
the
swinging stair when it is extended was not a labeled fire window
frame, as required by NFPA 80 Section 12-1.1, 1983.
One method, among other methods to abate these conditions is to
install fire rated windows and window frames.
(b) Second Floor Roof:  The double hung windows located on the
second
floor roof adjacent to the platform leading from stairwells 1 and 2
were not of the fixed type nor were they equipped with automatic
closures, as required by NFPA 80 Section 12-5, 1983.  One method
among
other methods to abate the condition is to install automatic
closures
or fix the windows in a closed position.
(c) Second Floor Roof:  The second floor roof, which serves as an
integral component of the means of egress for stairwells 1 and 2 did
not have a fire resistance rating of two hours, as required by NFPA
101 5-2.2.5.3, 1991.  One method among other methods to abate the
condition is to construct the second floor roof with a material that
has a fire resistance rating of two hours.
(d) Stairwells 1 and 2:  The existing signs located in stairwells 1
and 2 were inadequate in that the signs did not indicate the
terminus
of the top and bottom of the stairwells and the floor of exit
discharge.  Also, the existing signs were not readily visible when
the
doors were in the open and closed positions, as requiured by NFPA
101
Section 5-2.2.6.6, 1991.  One method among other methods to abate
the
condition is to affix appropriate signs at each floor landing of
stairwells 1 and 2.
(e) Second Floor Roof:  The handrails of the swinging stairs located
on the second floor roof were not designed to prevent the
possibility
of injury to individuals in that shear points and nip points were
created when the stairs swing downward, as required by NFPA 101
Section 5-2.8.7.5, 1991.  One method among other methods to abate
the
condition is to guard the nip points and shear points.
(f) Second Floor Roof:  A locking device was installed on the
swinging
stairs, in violation of NFPA 101 Section 5-2.8.7.9, 1991.  One
method
among other methods to abate the condition is to remove the locking
device.
(g) Stairwell 2, 12th Floor:  The fire escape ladder located between
the 12th and 11th floor did not comply with the requirements of NFPA
101 Section 27-2.2.10, 1991.  One method among other methods to
abate
the condition is to install a standard set of stairs.
