Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in that, employees were exposed to the
hazards of a fall from an elevation in excess of 12 feet as employees
worked
from a makeshift platform that was supported by the midrail of an economy
scissor lift:
A & P, Highland Ave., Seekonk, MA:  Employees, working on a
makeshift
platform that was supported by the midrail of an economy scissor
lift,
were exposed to the hazards of a fall from an elevation in excess of
12 feet. Among other methods, one feasible and acceptable abatement
method to correct this hazard is to utilize a lift that is capable
of
reaching the required working height and that allows employees to
work
from the approved
