General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees when compressed air is transmitted through polyvinyl chloride (PVC) pipe, exposing employees to the hazard of being struck by flying fragments: The employer is not limited to abatement methods suggested by OSHA, i.e., methods explained are general and may not be effective in all cases. Other methods of abatement may be equally or more appropriate. Ultimate responsibility for determining the most appropriate abatement method rests with the employer, given its superior knowledge of the specific conditions on its worksite. The violation(s) described in this citation are alleged to have occurred on or about the day(s) the inspection was made unless otherwise indicated within the description given below each violation. a. Polyvinyl chloride PVC pipe was installed in the west plant and used to transmit compressed air to machinery and hand held tools. Feasible abatement methods to correct this condition may include but are not limited to, 1) enclosing the polyvinyl chloride (PVC) line in a conduit pipe of sufficient strength to provide protection from external damage and prevent employees from being struck by flying fragments; 2) install a pipe system designed for compressed air as recommended by the American National Standards Institute/American Society of Mechanical Engineers (ANSI/ASME) B 31.8-1986 sections 842.32, 842.43 and 849.52 (b) Gas Transmission and Distribution Piping System.
