General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. Employees were exposed to the hazard of explosion and fire in a confined space which could result in death. Reclamation area, 18 wheel tanker. Employees were required to work inside a tanker cleaning out hardened graphite and fuel oil sludge with a metal hoe while diesel fuel was being introduced into this confined space so as to help dissolve the hardened graphite sludge. Among other methods, two feasible and acceptable abatement methods to correct this hazard are: 1. Externally, utilizing a pressurized water spray system to clean the inside of the tanker. 2. Implementation of the company's written confined space program and elimination of diesel fuel or any flammable/combustible liquids within the tanker when the employees are inside.
