Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
The hazard of being struck by a 1/2 inch diameter wire rope
daily or loaded carts of brick weighing approximately 19,000
pounds are pulled from the kilns to the Stacking Area at the
west track of the Packaging Area by a floor mounted wire rope
and sheave system that has improperly applied, improperly
spaced and an insufficient number  of U-bolt clamps securing
the wire rope to the brick carts.
Among other methods, one feasible and acceptable method to
correct this hazard is to install the U-bolt clamp with the
saddle part on the line end of the wire rope, space them 3
inches apart tightening the U-bolt clamps sufficiently to
prevent them from slipping together and install 3 U-bolt clamps
instead of 2 clamps.
The employer is not limited to abatement methods suggested by OSHA;
i.e., methods explained are general and may not be effective in all
cases.  Other methods of abatement may be equally or more appropriate.
Ultimate responsibility for determining the most appropriate abatement
method rests with the employer, given its superior knowledge of the
specific conditions on its worksite.
