Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The employer is not limited to abatement methods suggested by OSHA, i.e., methods explained are general and may not be effective in all cases. Other methods of abatement may be equally or more appropriate. Ultimate responsibility for determining the most appropriate abatement method rests with the employer, given its superior knowledge of the specific conditions on its worksite. (a) Dental assistants, dental hygienist, and dentist are exposed to the hazard of being infected by HBV and/or HIV and/or other blood borne infectious agents through possible contact with blood or other body fluids. Feasible and useful abatement methods for reducing this hazard, among others are: (1) Training and Education of Health Care Workers. All health care workers must receive education on precautionary measures, modes of transmission, and the prevention of HBV, HIV, and other blood- borne infectious diseases. Pregnant personnel shall be counseled regarding possible risks to the fetus from HBV, HIV and other blood-borne infectious agents. (2) Handwashing. After removing gloves, hands or other skin surfaces shall be washed thoroughly and immediately after contact with body fluids. (3) Establishing follow-up procedures after possible exposure to HIV or HBV. 2) THE EMPLOYER SHALL IDENTIFY EMPLOYEES AT SUBSTANTIAL RISK OF DIRECTLY CONTACTING BODY FLUIDS. ALL SUCH EMPLOYEES SHALL BE OFFERED HEPATITIS B VACCINATIONS FREE OF CHARGE IN AMOUNTS AND TIMES PRESCRIBED BY STANDARD MEDICAL PRACTICES, AS STIPULATED BY THE CENTER FOR DISEASE CONTROL, ACQUIRED IMMUNODEFICIENCY SYDROME, AIDS RECOMMENDATIONS AND GUIDELINES.
