The employer is not limited to the abatement methods suggested by OSHA;
the methods explained are general and may not be effective in all cases;
and the employer is responsible for selecting and carrying out an effective
abatement method.
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that:
Employee(s) were exposed to the hazard of fire and explosion
which could result in severe burns, multiple traumatic
injuries and/or death in that:
I.  The employer did not utilize effective process controls
to prevent employees exposure to fire and explosion in that:
A.  The employer did not operate the oxychlorination
reactors with the designed process controls
implemented to prevent an uncontrolled reaction resulting
in fire and explosion in that:
1.  The employer operated the VR201A, VR201B and
VR201C with the oxygen analyzers of the feed stream
being unreliable and in an ESD (emergency shutdown)
bypass mode as normal operating conditions.
2.  The employer operated VR201A and VR201B with
the inlet pressure controller of the feed to the
reactors in an ESD (emergency shutdown) bypass mode
as normal operating conditions.
3.  The employer operated VR201B with the high
pressure discharge controller in an ESD (emergency
shutdown) bypass mode as normal operating conditions.
4.  The employer operated VR201A and VR201B with
the high temperature controller in an ESD (emergency
shutdown) bypass mode as normal operating conditions.
B.  The employer did not operate the Ethylene
Dichloride crackers with the designed process controls
to prevent fire and explosion in that:
1.  The employer operated the Ethylene Dichloride
crackers VR401A, VR401B, VR401C with the EDC feed low
flow controller ESD (emergency shutdown) bypassed as
normal operating conditions.
2.  The employer operated the Ethylene Dichloride
crackers VR401A, VR401B, VR401C with the low flow
quench controller ESD (emergency shutdown) bypassed as
normal operating conditions.
3.  The employer operated the Ethylene Dichloride
cracker VR401A, VR401B, VR401C with the low fuel gas
pressure controller ESD (emergency shutdown) bypassed
as normal operating conditions.
Feasible abatement methods to correct these conditions may include but are
not limited to installing and maintaining reliable analyzers/controllers to
assure the correct measurement of critical control parameters of chemical
processes; implementing an effective Chemical Process Safety Management
Program that includes such elements as a process hazard review, a job safet y
analysis and a human factor analysis, of the VCM and PVC plants.
A Process Safety Management Program should at minimum (a) systematically
investigate each element of a process design and its hardware, to identify
all of the ways in which deviations can occur from intended design para-
meters to create hazard or operability problems, (b) examine working con-
ditions which influence the performance of human operators, maintenance
staff, technicians and other personnel, and identify features of the job
design likely to produce significant human error or accident event se-
quences, and (c) systematically list the process hazards and types of human
errors likely to be encountered during normal and upset/emergency con-
ditions, the factors creating such process hazards and potential accident
sequences, and the proposed system modifications and corrective action to
eliminate the hazards and/or the potential for human error.
II.  The employer did not maintain flammable liquid storage
vessels containing Class 1B and 1C flammable liquids to
prevent corrosion perforation thus negating the vent system
installed to control venting, nor was the vessel inerted,
exposing employees to the hazards of fire and explosion:
A.  VCM tank farm,  the roof of the EDC storage tank
VT-730 was corrosion perforated and venting flammable
vapors.
B.  VCM tank farm, the roof of VT-763B was corrosion
perforated and venting flammable vapors.
One method of abatement is to repair the roof and eliminate
perforation which will allow the controlled venting of
flammable vapors in accord with the requirements of 29 CFR
1910.106(b).
