Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the potential hazard of toxic, flammable and unknown atmosphere in a
confined space:
a) Acetone Recovery Charcoal Filters:
Maintenance workers were exposed to the hazardous conditions associated
with entry into the confined space of an acetone recovery charcoal
filtration system with deficiencies as follows:
A) A qualified person did not periodically test for atmospheric
contaminants from the lowest to the highest elevation of the confined
space to determine the conditions that employees may encounter
Reference ANSI Z117.1 - 1977 Section 4.1.1).
B) Safety harnesses and lifelines were not available and used by
employees entering confined spaces to effect a rescue in the event of
a medical or other emergency (Reference Section 4.24.2 of ANSI Z117.
1-1977).
C) An authorized person provided with appropriate personal protective
equipment was not stationed outside of the confined space, holding
the lifelines and observing or maintaining communications with the
employees in the confined space (Reference Section 4.2.4.3 of the
above mentioned consensus standard).
D) An entry permit which insures that a qualified person determine which
steps of Section 3 or 4 of ANSI Z117.1-1977 be taken and complied
with was not issued prior to the entry of the confined space.
b) Acetone Recovery Filtration Box:
Maintenance workers were exposed to the hazardous conditions
associated with entry into the confined space of an acetone recovery
particulate filtration box. The deficiencies in instance (a) above
(See A-D) were also present during this instance of confined space
entry.
C) Cellulose Acetate Mixer:
Maintenance workers were exposed to the hazardous conditions
associated with entry into the confined space of an acetone/
cellulose acetate mixing machine as the deficiencies in instance (a)
above (See A-D) were present during this confined space only.
Among other methods, one feasible and acceptable abatement method to
abate these hazards is to implement a confined space entry procedure
which includes but is not limited to the procedures outlined in ANSI
Z-117.1-1977.
