Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Foot of Starboard Street, Newark NJ 07114:
The hazard of being struck and/or crushed by the catepillar front
end loader 988B, identification number 8. Employee was working along
side of and behind equipment. This equipment was equipped with an
audible warning which was not audible above the surrounding noise.
One feasible and available method of abatement is to install an audible
warning reverse alarm which is audible above the surrounding noise.
Reference is made to the National Safety Council Data Sheet 589, 1977
Revision B, and the construction standard 29 CFR 1926.601(a)(9) and
1926.601(b)(4)(i) and Society of Automotive Engineers, Front End Loader
SAE J237-1971.
