Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Foot of starboard Street, Newark, NJ 07114 The hazard of being struck and/or crushed by the Caterpiller front and loader, 9888 identification number 8. Employee was working along side and behind equipment. This piece of equipment. This Piece of equipment was equipped with the audible warning alarm which was not audible above the surrounding noise. One feasible and available method of abatement is for the employer to inspect that all equipment to which Naparano Iron and Metals employees are exposed are properly equipped with the required warning alarm system. Reference is made to the National Safety Council Data sheet 589, 1977 Revision B and the Construction Standard 29 CFR 1926.601(b)(4)(i) and Society of Automotive Engineer, Front End Loader SAE J237-1971. Violation occurred on or about 5/1/90
