Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to the employee in that:
a)  36 White Terrace, Newark, NJ;
Employee exposed to electrocution while removing tree lines, contacted a
two hundred twenty
volt, single phase, electric line, during a tree removal operation,
resulting in the fatal injury of
the employee.
Among other methods, one feasible and acceptable method to correct this
hazard is to maintain
a minimum clearance of 10 feet (3 meters) from energized conductors rated
50 KV
phase-tophase
or less when performing tree work other than line clearance tree
trimming as described
in ANSI 2133.1-1988 4.2.5.
