Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that "window
cleaners" were exposed to a fall hazard of over 100ft.
a). On September 21, 1995 an employee was cleaning windows on the 11th
floor of the
Murdock Bldg. at the Jersey City Medical Center. He fell to his death when
the safety belt he
was provided and utilizing failed.
Amongst others, feasible an acceptable abatement methods include but are
not limited to:
a. Provide and maintaining window cleaner's belts in a safe condition at
all times
b. Routinely inspecting, especially prior to each use, all safety belts
for any sign
of deterioration, wear or defects or for anything that could possible call
its
integrity into question.
c. Thoroughly train all employees, especially window cleaners, to
recognized the
need to not utilize any belt which has any sign of deterioration, wear,
defects,
damage etc, which could compromise its strength and integrity.
