Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling out of the bucket of a hydraulic excavator while it was being raised out of an unprotected trench. a)At the job site, Hawley St., Binghamton, NY, on or about 11-21-2000: Employee working in the trench was removed from the trench by riding in the bucket of a Cat 215B Hydraulic Excavator, exposing the employee to a fall into a trench that was at least nine feet in depth with accumulating water from a water main break. Among other methods, several feasible and acceptable methods of abatement to correct the hazard are to: 1)Prohibit employees to ride in and work from the bucket of any hydraulic excavator. 2)Follow the recommendations contained in the Construction Industry Manufacturers Association (CIMA) manual " Safety Manual for Users, Operators and Maintenance Personnel Hydraulic Excavator." Abatement certification must be submitted for this item.
