Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling steel web joist: a)At the job site, Watkins Glen School Bus Garage, Watkins Glen, New York on or about 01-18-2001: On a multi-employer worksite, employees were exposed to the hazard of falling open web steel joist while operating an all terrain fork truck under joists that had not been secured by tack welding or bolting. Among other methods, a feasible and acceptable method of abatement to correct the hazard is to establish a no access area where structural steel is being erected until the materials are secured.s
