Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the falling load should the hoist or bellow the hook lifting device fail: a)In the workplace, Bean Room, on or about 06-13-2001: The overhead hoist had a non functioning upper limit device. Among other methods, several feasible and acceptable abatement methods to correct this hazard are to: 1.Repair or replace the upper limit device. 2.Conduct frequent and periodic inspections of the hoist in accordance with ANSI B30.16-1987, Over Head Hoists. b)In the workplace, as identified, the following over head hoists were attached to travel and support beams that were not identified with the rated load capacity: 1)Building 57, third floor, Remix, over head hoist. 2)Liquid Shipping, Rail for LD#259 & LD#500. 3)Building 95, Hoist traveling rail beams #202,203 & 206. 4)Pump House, Traveling rail beam for hoist. Among other methods, feasible and acceptable methods of abatement to correct this hazard is to: 1.Identify and mark the maximum capacity load for the support structure of installed overhead hoist. 2.Conduct frequent and periodic inspections of the hoists and support members, rails, in accordance with B30.16-1987, Over Head Hoist. c)In the workplace, at locations and equipment identified, on or about 06-08- 2001, the following below-the-hook lifting devices did not have rated load marking and initial, frequent or periodic inspections had not been performed: 1)Bean Room, attached to overhead hoist at bean dump area. 2)Morsel Packaging Area, LD# 256. 3)Morsel Packaging Area, LD# 257. 4)Stock Room, Maintenance Area, second floor, load basket. 5)Roasting, Penthouse, at top of stairs, attached to powered hoist. 6)Building 58-1, Cold handling storage. 7)Building 57-2, mixing area. 8)Building 56-2, South Morsel Line/ butter scotch. 9)Liquid Shipping, LD# 200. 10)Liquid Shipping, LD# 260. 11)Pumphouse, overhead hoist. 12)Refining, at the continuous mix, 3 each hoists with devices. 13)Liquor and Press, at the Hogs. Among other methods, several feasible and acceptable abatement methods to correct the hazard are to: 1.Prior to initial use, all new, modified or repaired lifting devices shall be inspected by a designated person and an operational test performed to verify compliance. 2.Mark the rated load capacity of the lifting device or affix a tag. 3.Conduct frequent and periodic inspections of the lifting devices for wear, deterioration or malfunction in accordance with ASME B30.20. Abatement certification is required for this item.
