Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of approximately 30: a)At the job site, Broome County Office Building, Binghamton, NY, on or about 05-08-2001: An employee was observed performing window cleaning services from a Boatswains Chair that was suspended from a portable single point suspension system on the roof of the building. The portable suspension system did not have the required tie back line or the required number of counter weights, as indicated in the manufacturer's written operating instructions. Among other methods, feasible and acceptable methods of abatement to correct this hazard is to follow the requirements of the manufacturer's operation and maintenance manual for the MIO 250S rolling roof anchorage, to include securing the suspension system frame by use of tiebacks, and using all six pieces of the provided counter weights.
