Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or thrown from fork trucks: a)Throughout the facility, on or about 2/10/99: Employees are operating a Caterpillar Fork Truck model number 695-3, serial number 924556 and were not wearing seat belts provided on the fork lift truck. Employees are exposed to the hazard of being struck by or thrown from the fork truck in an accident. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Require and enforce the use of seat belts that are provided on the fork truck. 2. Follow the requirements of American National Standards for Safety Standard for Low Lift and High Lift Trucks (ASME B56.1-1993, Chapter 5.3.19. Abatement documentation must be submitted for this item.
