Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employee in that: Employees were exposed to the hazard of being infected with Mycobacterium Tuberculosis through repeated and prolonged indoor contact with active or suspecte TB patients: a) St. Francis Community Hospital, Jersey City, NJ; Nurses, nurse assistants, respiratory therapists, technicians, transportors, phlebotomists, and housekeeping employees who were exposed to the hazard of being infected with Mycobacterium Tuberculosis through contact with active TB patients were not provided with Mantoux PPD skin test as recommended by the CDC Guidelines. b) Nurses who were exposed to the hazard of being infected with Mycobacterium Tuberculosis through repeated contact with active or suspect tuberculosis patients that occupied rooms not provided with negative pressure. Including but not limited to: ICU, Rooms #1 and #2. Among other methods, some feasible and acceptable abatement methods to correct this hazard as recommended by the CDC guidelines are: 1. Provide workers with frequent exposure to patients with TB or are involved with high hazard procedures the Mantoux PPD test at least every six months. 2. Rooms occupied by TB or suspecte TB patients must be under negative pressure exhaused to the outside and away from intake vents. 3. Provide a rapid diagnostic service to place active TB patients in AFB isolation. 4. Provide training for employees in the mode of transmission of TB.
