Section 5(a)(1) of the Occupational Safety ad Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serous physical harm to
employees in that
employees were exposed to: The employer did not protect employees from
the recognized
hazard of airborne styrene exposure.
At the workplace; employees engaged in production of cultured marble
products were
exposed to airborne styrene at the following eight (8) hour time weighted
average (TWA)
concentrations and short term exposure limit (STEL) concentrations:
a) An employee engaged in "pouring" uncured resin into molds was exposed
to airborne
styrene at an 8 hour TWA of 75 parts per million (ppm) which is 1.5 times
the American
Conference of Governmental Industrial Hygienists (ACGIH) 8 hr TWA limit
of 50 ppm. This
level was obtained during a 251 minute sampling period. In addition, this
employee
had 7
instances of exposure to airborne styrene above the ACGIH STEL limit of
100 ppm. These
exposures ranged from 126 to 212 ppm.
b)An employee engaged in paddling uncured resin in molds was exposed to
airborne styrene
at an 8 hr TWA of 62 ppm which is 1.2 times the ACGIH 8 hr TWA limit of
50 ppm. This
level was obtained during a 246 minute sampling period. In addition this
employee had 7
instances of exposure to airborne styrene above the ACGIH STEL limit of
100 ppm. These
exposures ranged from 121 to 164 ppm.
c) An employee engaged in transporting the bucket of uncured resin during
pouring
operations, helping the mixing of the uncured resin, and paddling the
uncured resin in molds,
was exposed to airborne styrene at an 8 hr TWA of 60 ppm which is 1.2
times the ACGIH 8
hour TWA limit of 50 ppm. This level was obtained during a 238 minute
sampling period. In
addition, this employee had 7 instances of exposure to airborne styrene
above  the ACGIH
STEL limit of 100 ppm. These exposures ranged from 111 to 164 ppm.
These levels were obtained during the aforementioned sampling periods on
January 27, 1994.
Zero exposure was assumed for unsampled periods of time. The health
effects of styrene are
moderate eye, nose, throat and skin irritation, nervous system
disturbances (drowsiness,
weakness, unsteady gait), and narcosis. In addition, styrene is given a
carcinogenic
classification by IARC (International Agency for Research on Cancer) of
Group 2B, meaning
that it is possibly carcinogenic to humans.
Feasible and useful abatement methods for reducing the hazard include,
but are not limited
to:
Step 1: Abatement - May 18, 1994
Effective respiratory protection shall be provided and used by exposed
employees
as an
interim protective measure until feasible engineering and/or
administrative controls can be
implemented, or whenever such controls fail to reduce employee exposure
to within
permissible limits.Step 2: Abatement - June 21, 1994
Submit to the Area Director a written, detailed plan of abatement
outlining a schedule for
implementation of engineering and/or administrative measures to control
employee exposure
to hazardous substances as referenced in this citation. This plan shall
include, at a minimum,
target dates for the following actions which must be consistent with the
abatements dates
required by the citation:
1) Evaluation of engineering/administrative control options;
2) Selection of optimum control methods and completion of design;
3) Procurement, installation and operation of selected control measures;
and
4) Testing and acceptance or modification/redesign of controls.
NOTE: All proposed control measures shall be approved for each particular
use by a
competent industrial hygienist or other technically qualified person.
Ninety (90) day progress
reports are required during the abatement period.
Step 3: Abatement - August 3, 1994
Abatement shall have been completed by the implementation of feasible
and/or administrative
control upon verification of their effectiveness in achieving compliance.
