Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads/parts: (a) Service Area; The automotive lifts were not maintained in a safe operating condition. The lifts had the following defects: (Bay 1) Globe FS-10-AS: Top 2" of piston is slightly pitted, safety leg does not operate automatically, air valve worn out, arm stop rivets are inoperable, pad and sleeve assemblies are not operating freely, and the arm bolts and spacers are severely worn. (Bay 2) Globe FS-10-AS: Top 2" of piston is slightly pitted, safety leg does not operate automatically, air valve worn out, arm stop rivets are inoperable, pad and sleeve assemblies are not operating freely, safety strap missing from sleeve assemblies, and the arm bolts and spacers are severely worn. (Bay 3) Globe FS-10-AS: Top 2" of piston is slightly pitted, air valve worn out, arm stop rivets are inoperable, pad and sleeve assemblies are not type used for this lift, and the arm bolts and spacers are severely worn, and lift jumps toward the end of its stroke. Jumping indicates that the lift is low on oil. (Bay 6) Globe FS-10-AS: Top 2" of piston is slightly pitted, safety leg does not operate automatically, arm stop rivets are inoperable, pad and sleeve assemblies are not operating freely, safety strap missing from sleeve assemblies, and the arm bolts and spacers are severely worn. (Bay 8) Rotary DTO-28H: The top 2" of the piston is rusted, arm lock pins don't work, safety locks stick, oil valve leaks from shaft, and there is approximately 20 gallons of pure water in lift tank. Air lines to lift are improperly installed, and as such create a situation where the water build-up is draining into the lift tank each time it is
