arising from the unexpected rupture of a tank:
(a)  Tank #1;  Inspection and testing of certain tank components which
acted to keep
pressure in the tank to below 5 p.s.i. were not adequate.
Among other methods, feasible and acceptable abatement methods to correct
this hazard are:
1.  Any safety devices, or devices which serve as safety devices in that
they act to maintain pressure in
the tank to below 5 p.s.i. shall be part of a regularly scheduled
inspection and testing program.  Any
defects/problems which are discovered that may affect the proper
functioning of these devices will be
immediately corrected.  The company will send this protocol to the
Pittsburgh Area Office of OSHA
within 15 days of the signing of this settlement agreement for review.
2.  All inspections of the safety devices referred to above will be
performed by qualified individuals.
3.  Only OBM parts will be used in the above referenced devices.
4.  Atmospheric corrosion inspections will continue to be conducted.
5.  The "Protectoseal" units will continue to be cleaned on an annual
basis.

(a)  #1 Tank;  Workers performing maintenance, repairs and services to the
"Protectoseal" pressure relieving devices on the 12,000 gallon distillate
tank and the
device either clogged or malfunctioned causing the tank to fail.
Inspection revealed the
device interior was corroded and the top plate "O" ring was crushed and
flattened.  There
was no documented quality control system for testing and repair.  This
condition exposed
workers to fire and explosion hazards.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to have
a documented quality control program and repair personnel trained and
qualified meeting all applicable
provisions of American Petroleum Institute API 510 Seventh Edition dated
March, 1992 with Supplements
1 and 2.

applicable provisions of American Petroleum Institute API 510 standard
dated March, 1992 Seventh
