Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were not protected from falling as they descended the tower uprights (legs) and unhooked their single lanyard (at a cross member) and reconnected it under the cross member. The fall hazard to employees was up to at least 60 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to either install safety nets or have the employees use two lanyards leaving at least one connected at all times.
