Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) D.L. Clark Building; In that workers engaged in window washing activities were exposed to a fall hazard of 74 feet when attempting to mount the Sky Genie/Boatswain's Chair. This was due to the lack of training of employees prior to use of the equipment, no inspection conducted of the equipment prior to use, improper rigging and no tiebacks, and the lack of an independent fall arrest system. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop an employee training program on the safe use of a Sky Genie, to inspect the equipment prior to its use, to install proper rigging, and to develop and implement separate fall arrest system.
