Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the fire and/or explosion hazards associated with the asphalt mixers: a.Asphalt Mixing Tanks - Employees were exposed to fire and/or explosion hazards associated with the 16-ton mixing tanks due to the lack of operational and emergency controls on the mixing vessels. ABATEMENT NOTE: One method among others to abate the hazards is to install monitors, alarm systems, and hazard control mechanisms to prevent overheating and the generation of potentially hazardous conditions.
