Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls from the forks of the forklift. a.Site - Employees were allowed to work from the elevated forks of the forklift. ABATEMENT NOTE: Among other methods, two feasible and acceptable methods of abatement are to comply with the owners's manual for the unit or to consult generally accepted practices such as those found in American National Standards Institute B56.1 -1993.
