Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn hazards associated with the uncontrolled release of energy from a buildup of hot ash in the Precipitator Hopper: a.Precipitator Repair Job - Employees were exposed to the uncontrolled release of energy from hot ashes due to the failure to recognize and take steps to protect employees from hazards associated with the hot ash buildup in the Precipitator Hopper. ABATEMENT NOTE: Some methods, among others, to protect employees from hazards associated with hot ashes include protecting exposed employees with thermal protective suits or comparable personal protective equipment, and providing training to recognize the special hazards associated with hot ashes in confined spaces.
