Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazards of fire, explosion, oxygen deficiency, and toxic
atmospheres:
a.Rose Lane Jobsite - On or about 8/31/93, employees of National Service
Group
Inc. were exposed to potential fire, explosion, oxygen deficiency or
toxic levels
of materials such as, but not limited to, xylene, toluene, n-butyl
acetate, and
nbutyl
alcohol while applying and spray finishing coating in a confined
space
(Tank #4) without the benefit of a fully developed and implemented
confined
space entry program, in that elements such as, but not limited to the
following,
were not addressed:
(1)The hazards involved were not properly identified and addressed prior
to
entry.  The hazards also were not examined with respect to hazard
exposure, magnitude and likelihood and consequences, staging for hazard
control, and impact on the need for emergency response.
(2)The permit did not address the changing conditions in the tank during
spray operations.
(3)The space was not marked as a "confined space."
(4)The attendant/rescue person was not stationed at the tank opening.
Attendant duties are as follows:
(a)Provide standby assistance to occupants entering the confined
space.
(b)Direct occupants to exit the confined space when any irregularities
are observed.
(c)Initiate evacuation and emergency procedures.
(d)Monitor for conditions that could adversely affect the entry.
(e)Remain at the entry point unless relieved by another attendant.
(5)The attendant and occupant were not in constant two-way communication.
(6)When ventilation was not possible or feasible, alternative protective
measures or methods to remove air contaminants or protect occupants
were not determined by the qualified person prior to authorizing entry.
(7)Appropriate retrieval equipment was not used whenever a person enters
a permit required confined space.(8)A plan of action was not written with
provisions to conduct a timely
rescue for individuals in a confined space should an emergency have
arisen.  Included in the provisions should be, at least:
(a)Determination of what methods of rescue must be implemented to
retrieve individuals.
(b)Designation of rescue personnel that are immediately available
when entries are conducted.
(c)Type and availability of equipment needed to rescue individuals.
(d)An effective means to summon rescuers in a timely manner.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method
to correct these hazards is to implement and enforce a confined space
entry program in
accordance with American National Standard Safety Requirements for
Confined Spaces
(ANSI)Z117.1-1989.
b.Rose Lane Jobsite - On or about 8/31/93, employees of National Service
Group
Inc. were exposed to potential fire and explosion hazards while applying a
flammable spray finishing coating in a tank where the components of the
airless
spray coating application system had not been tested to determine the
quality of
electrical conductivity; proper electrical bonding procedures had not
been taken;
and equipment of different manufacturers had been combined in the same
system.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement
method
to correct these hazards is to follow the airless spray system's
manufacturer recommendations
as well as the National Fire Protection Association NFPA-77 entitled,
"Recommended Practice
on Static Electricity."
