Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to the employee in that
employees were exposed to serious crushing injuries on the first
floor level from the Vertical Reciprocating Conveyer transmission
materials from the first floor level to the second floor level.
A feasible and acceptable method to correct the hazards, among
other methods, is to provide electrically and mechanically
interlocked gates to prevent them from being opened until the
platform has reached the level:
a)  Warehouse
The (no identification) Vertical Reciprocating Conveyor was not
equipped with mechanically interlocked gates exposing employees to
serious crushing injuries.  The gates on the first floor level were
designed to be open when operating the platform to reach the second
