Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or like-
ly to cause death or serious physical harm to employees:
Employees were exposed to the hazard of asphyxiation due to the
potential presence of an oxygen deficient atmosphere due to a
catastrophic release of nitrogen gas into the workplace:
Feasible and useful abatement methods for reducing this hazard,
among others are:
1. Install a ventilation system to prevent the displacement of
oxygen by the nitrogen used at the Cryo-Grind Mill (as specified
in the Cryo-Grind Mill operations manual provided by the manu-
facturer, Air Products and Chemicals, Inc.).
2. Install an oxygen monitor at the Cryo-Grind Mill to warn employ-
ees of the presence of an oxygen deficient atmosphere (reference
Compressed Gas Association pamphlet P-12).
3. Modifiy the liquid nitrogen piping system, such that the four
pressure relief valves for the nitrogen system utilized at the Cryo-
Grind Mill are vented  to the outside (as specified in the Cryo-Grind
Mill operations manual provided by the manufacturer, Air Products and
Chemicals, Inc.) not into the work area as they were on 6/13/91.
