Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Atmospheric conditions which may be Immediately Dangerous to Life or Health (IDLH) i.e. oxygen deficient or excessive levels of welding fumes and gases during welding operations. One feasible and acceptable means of abatement would be to institute a confined space entry permit system which include: 1) A documented policy defining confined spaces. 2) Hazard assessment procedures. 3) A confined space entry permit system.
