Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall hazard which could result in serious physical harm or death while working off a portable ladder above the guardrails at the edge of the floor level: (a) Job site: Employees exposed to fall hazard and serious physical harm or death while working off a portable ladder above guardrails without any fall protection. Among other methods of abatement, would be safety belts, mobile scaffold or scissor lifts.
