Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious injuries while riding in the bucket of a front end loader. The employees were holding onto a small tree that was also being transported in the loader bucket. This exposed employees to the hazards of falling out of the bucket while the loader was in motion; or lung crushed by an unexpected movement of the load carried. NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to prohibit employees from riding in or on vehicles or parts of vehicles that are not designed for the safe transport of employees.
