Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by falling vehicle(s) when lowering the two post, free wheeling, rotating arms, semi-hydraulic frame lift from the fully extended position due to faulty (jerking) lift movement. This lift was located in the northwest area of the shop and was used for repair of brakes and exhaust systems. Among other methods, a feasible and acceptable abatement method to correct this hazard is to comply with the safe operating procedures and safety inspection requirements recommended by the manufacturer and the Automotive Lift Institute such as, but not limited to: 1) Routinely scheduled preventive maintenance of the lift to ensure that all components function properly. 2) Installation of a low oil supply control device to ensure smooth operation of the lift.tion
