Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. There was no limit switch on the Whiting stationary overhead hoist in the east yard on June 10, 1991, exposing employees to a struck-by hazard when the block fell. Reference ANSI B30.16-1973. Among other methods, one feasible and acceptable method to correct this hazard is to install a limit switch to shut of the hoist when a certain height is attained.

The marked capout of the hoist was not visible from the ground under the hoist on the Whiting overhead hoist in the east yard exposing employees to a struck-by hazard. Reference ANSI B30.16-1973. Among other methods, one feasible and acceptable method to correct this hazard is to mark the capacity so it is visible from the operator positions.
