SECTION 5(A)(1) OF THE OFUPATIONAL SAFETY AND HEALTH ACT OF 1970; THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO: A) THE ROBBINS AND MEYERS EAST AND WEST OVERHEAD HOIST WERE NOT MARKED AS TO THEIR CAPACITY IN THE BRIDGE SHOP EXPOSING EMPLOYEES TO A STRUCK BY HAZARD. ONE FEASIBLE METHOD OF ABATEMENT AMONG OTHERS WOULD BE TO MARK THE HOISTS AS TO THEIR CAPACITY AS REQUIRED BY ANSI B.3017(1985) SECTION 17-1.1 B) THE ROBBINS AND MEYERS HOIST IN THE BACK SHOP WAS NOT MARKED TO INDICATE ITS CAPACITY EXPOSING EMPLOYEES TO A STRUCK BY HAZARD. ONE FEASIBLE METHOD OF ABATEMENT AMONG OTHERS WOULD BE TO MARK THE CRANES AS TO THEIR CAPACITY AS REQUIRED BY ANSI B30-1985, SECTION 17-1.1
