General-duty citation text
Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) A caterpillar 950, serial number 43J15446, being operated in the south end of the construction office parking lot, had a rider other than the operator riding on the left side where a seat, and seat belt was not available, and where the equipment was not designed for any riders other than the operator, thereby exposing employees to possible crushing injuries. (b) Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit riders other than the operator on this type of equipment.
